What is a rectification order in Victoria?

A rectification order is a direction from the Building and Plumbing Commission to fix defective, non-compliant or incomplete building work. The power started on 1 July 2026. It can be used up to ten years after the owners moved in, and it reaches work finished before the power existed. Orders go to the builder, and on apartment buildings to the developer as well. They are published on the public Register of Building Practitioners until they are complied with. The builder’s best position is a record of the work: what was built, who checked it, when, and how each complaint was answered.

The register is the part builders will feel

Victorian builders have faced defect claims for years. What is new is the route and the visibility. An owner no longer has to take a builder through dispute resolution and VCAT to get an order. The Commission can inspect and issue one, and the order sits on the same public register prospective clients use to check a builder’s registration. It stays there until the work is fixed.

The reach is the other half. Ten years after occupancy, retrospective to work done before July 2026, is longer than most builders keep a job’s photos findable. The defects folder archived when the retention came back is now evidence in a live process.

How an order happens

From complaint to the register, in five steps

    Usually through a home warranty complaint notice, or a complaint straight to the Building and Plumbing Commission. The builder has 28 days to answer a complaint notice.
  2. 2The Commission assesses and inspects
    If the matter is not resolved, the Commission triages it and in most cases sends an inspector. It prioritises cases where there may be evidence of a defect in a major building element.
  3. 3The order issues
    If the work is defective, non-compliant or incomplete, the Commission orders the person who did it to fix it, with any conditions it sets. For an apartment building that can be the developer as well as the builder.
  4. 4It goes on the register
    The order is published on the public Register of Building Practitioners. The regulations make that mandatory, for orders issued in the last five years.

    Or when VCAT or the Supreme Court sets it aside, or a court stays it. If the builder does not comply, a warranty claim pays the owner and the Commission can pursue the builder for the cost.
